Terms of Use

The short version: FixKon is privacy-first. Core features run entirely on your PC, nothing leaves your device. When you use AI features, your data is encrypted in transit, we collect only the minimum needed to provide the service, and we never sell it. Use the app responsibly, don’t abuse the credit system, and understand that system optimization tools carry inherent risk.

1. Acceptance of these Terms

These Terms of Use (“Terms”) are an agreement between you and Unex Technologies LLC, a Virginia, USA limited liability company (“FixKon,” “we,” “us,” or “our”). They govern your use of the FixKon desktop application, our website, and related services (together, the “Service”).

By downloading, installing, or using FixKon, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. License to use FixKon

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use FixKon on Windows devices you own or control, for your own personal or internal business use. You may not:

  • Copy, modify, distribute, sell, rent, or sublicense the app or any part of it
  • Reverse engineer, decompile, or attempt to extract the source code, except where permitted by law
  • Remove or alter any proprietary notices or branding
  • Use the Service to build a competing product

3. Privacy and your data

FixKon is built privacy-first:

  • Local by default. Core features, System Cleanup, Startup Optimization, and Performance Presets, run entirely on your device. No files, file names, or system data from these features are ever transmitted to us or anyone else.
  • Encrypted in transit. All communication between the app and our servers, including AI requests, is encrypted using industry-standard TLS.
  • Minimal collection. We collect only what is necessary to operate the Service: your account email, credit balance, and the content you choose to send to AI features.
  • Never sold. We do not sell your personal information, and we do not use your chats or screenshots for advertising.

4. Accounts

Some features require a FixKon account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. We may suspend or terminate accounts that violate these Terms.

5. AI credits and payments

  • Free credits. New accounts receive a one-time grant of free AI credits. Free credits have no cash value and may be adjusted, limited, or discontinued at any time.
  • Subscriptions. Paid plans are billed on a recurring basis (monthly or annually, as selected at checkout) and renew automatically at the then-current price until you cancel. The renewal price and billing frequency are shown at checkout before you subscribe. You can cancel anytime from your account page or through the billing portal link in your receipt email; cancellation takes effect at the end of the current billing period, and you keep access until then. We will notify you in advance of any price increase to an active subscription, and you may cancel before it takes effect. Payments are processed by Lemon Squeezy and subject to its terms.
  • Credit packs. Additional credits can be purchased as one-time purchases. Payments are processed by our payment provider, Lemon Squeezy, and are subject to its terms.
  • Account-tied. Credits are tied to your account, not a device. They are non-transferable, non-refundable except where required by law, and cannot be redeemed for cash. Where you are entitled to a statutory withdrawal or cancellation right (for example, under EU consumer law), that right applies as described in our Refund Policy.
  • No abuse. Creating multiple accounts to farm free credits, sharing accounts, or circumventing credit limits is prohibited and may result in termination without refund.
  • Pricing changes. We may change credit pricing, pack sizes, or the credit cost of features at any time. Changes will not reduce credits you have already purchased.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Submit content to AI features that is illegal, infringing, or that you do not have the right to share
  • Attempt to probe, disrupt, overload, or gain unauthorized access to our servers or systems
  • Use bots, scripts, or automated means to access the Service or consume credits
  • Interfere with other users’ access to the Service

7. AI features disclaimer

FixKon’s AI chat and screenshot analysis features generate responses using artificial intelligence. AI output can be inaccurate, incomplete, or unsuitable for your situation. It is provided for informational purposes only and is not professional advice. You are responsible for reviewing AI suggestions before acting on them, especially suggestions that involve changing system settings, deleting files, or modifying your PC.

8. System optimization risks

FixKon includes tools that clean files, modify startup programs, and change system settings. While these tools are designed to be safe, any software that modifies your system carries inherent risk, including the possibility of removed files, changed settings, or unexpected behavior on some configurations.

You are responsible for maintaining backups of your important data. We strongly recommend backing up your system before applying optimizations. To the maximum extent permitted by law, we are not liable for data loss or system issues resulting from your use of these tools.

9. Intellectual property

FixKon, including its software, design, branding, and content, is owned by Unex Technologies LLC and protected by intellectual property laws. These Terms do not grant you any ownership rights. You retain ownership of the content you submit to AI features; you grant us a limited license to process that content solely to provide the Service.

10. Updates and changes to the Service

We may update the app, add or remove features, or change how features work (including which features are free or paid) at any time. We may also discontinue the Service with reasonable notice. We are not obligated to provide support, updates, or new features, though we intend to. Changes that materially reduce the core functionality of an active paid subscription will not take effect for you until your next renewal, or we will offer a pro-rated refund for the remainder of your term.

11. Termination

You may stop using FixKon and delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the credit system, or use the Service in a way that harms us or others. Upon termination, your license ends and unused credits are forfeited, except where a refund is required by law.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL IMPROVE YOUR PC’S PERFORMANCE BY ANY SPECIFIC AMOUNT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNEX TECHNOLOGIES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Unex Technologies LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) content you submit to the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party in connection with your use of the Service.

15. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally within 30 days.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by posting a notice on our website before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
